2. Acceptance of terms

By using this website, submitting a request, accepting a proposal, purchasing a service, or entering into a project with Volusia Websites, you acknowledge that you have read and agree to the terms that apply to the relevant activity.

If you do not agree with these Terms, do not use the website or purchase services.

3. Services and project scope

Services are provided according to the specific proposal, estimate, statement of work, order, subscription plan, or written agreement accepted by the client.

A project may identify:

  • Project objectives.
  • Deliverables.
  • Timeline or estimated schedule.
  • Client responsibilities.
  • Number of revisions.
  • Approval process.
  • Payment schedule.
  • Ownership or licensing terms.
  • Third-party services or expenses.
  • Maintenance or support terms.

Requests outside the agreed scope may require a new estimate, additional payment, a revised timeline, or a separate agreement.

4. Client responsibilities

The client agrees to provide accurate, timely, and lawful information, materials, approvals, access, feedback, and decisions reasonably needed to complete the work.

The client is responsible for confirming that supplied text, images, logos, music, trademarks, photographs, data, claims, and other materials may legally be used.

Delays in receiving content, access, feedback, approvals, payment, or decisions may affect the timeline.

5. Proposals, estimates, and changes

Estimates and proposals are based on the information available when they are prepared. A project may change if the requirements, content, integrations, platform, access, timeline, or requested deliverables change.

Volusia Websites will communicate material changes when reasonably possible. Additional work should be approved before it is performed whenever practical.

6. Payments

Payment terms are stated in the applicable proposal, invoice, order, subscription plan, or agreement.

Unless a written agreement states otherwise:

  • Work may not begin until required deposits or payments are received.
  • Invoices are due according to their stated payment terms.
  • Late or failed payments may pause work or support.
  • Third-party charges may be billed separately.
  • Taxes, printing, advertising, hosting, domains, software, licensing, and platform fees may be separate.

7. Monthly subscriptions and maintenance

Monthly services may include website care, creative production, social media support, analytics, content, marketing, or other agreed work.

Each subscription will identify the monthly fee, billing date, deliverables, request limits, turnaround expectations, revision policy, unused work policy, cancellation terms, and services that require a separate quote.

Subscriptions do not automatically include unlimited revisions, unlimited requests, printing, advertising, third-party software, emergency work, new websites, major redesigns, or custom software.

8. Website hosting, domains, and third-party services

Websites may depend on hosting providers, domain registrars, themes, plugins, payment processors, booking systems, email providers, analytics tools, APIs, and other third-party services.

Third-party services may have their own costs, terms, privacy policies, limitations, outages, changes, or security requirements. Volusia Websites is not responsible for failures caused by a third-party provider outside its reasonable control.

9. Revisions and approvals

The applicable project agreement controls the number and type of included revisions. A revision generally means a change to an existing approved direction, not a completely new concept or expanded project.

The client is responsible for reviewing information, links, prices, hours, contact details, claims, images, and other content before final approval or publication.

10. Ownership and licensing

Ownership, licensing, source files, editable files, stock materials, fonts, music, software, code, templates, photographs, third-party materials, and final deliverables are governed by the applicable written agreement.

Unless specifically transferred in writing, Volusia Websites may retain rights to its pre-existing tools, processes, templates, concepts, systems, know-how, reusable code, and general methods.

11. Portfolio and promotional use

Volusia Websites may display completed work, business names, testimonials, project descriptions, images, or results only when the client has granted permission or the use is otherwise authorized.

Any special confidentiality, embargo, private-label, or non-disclosure requirements should be stated in writing before work begins.

12. Marketing and performance results

Volusia Websites may improve websites, content, creative, customer journeys, tracking, local information, campaigns, and other marketing foundations. However, rankings, traffic, inquiries, sales, revenue, engagement, and other outcomes depend on many factors outside Volusia Websites’ control.

Volusia Websites does not guarantee a specific search ranking, number of leads, sales increase, revenue result, advertising outcome, or business performance unless a written agreement expressly states otherwise.

13. Custom technology and software

Custom technology projects require an agreed scope covering features, users, access, data, hosting, testing, security, deployment, maintenance, and future changes.

New features, changes in requirements, integrations, platform changes, security work, data migration, and post-launch support may require additional work or a separate agreement.

14. Acceptable use

Clients may not use Volusia Websites’ services to create or distribute unlawful, fraudulent, deceptive, abusive, infringing, harmful, hateful, or malicious content or activity.

Volusia Websites may decline or pause work that presents legal, ethical, security, safety, reputational, or platform-policy concerns.

15. Confidentiality

Each party should protect confidential information received from the other party and use it only for the agreed business purpose, subject to any separate confidentiality or nondisclosure agreement.

16. Cancellation and termination

Cancellation and termination terms are governed by the applicable proposal, subscription plan, invoice, or written agreement.

The agreement should address outstanding payments, work already completed, approved work, access credentials, files, subscriptions, third-party costs, final deliverables, and transition responsibilities.

17. Disclaimers

Services and website content are provided according to the agreed scope. Except where prohibited by law, Volusia Websites does not guarantee that a website, campaign, software system, integration, or service will be uninterrupted, error-free, compatible with every system, or produce a particular business result.

18. Limitation of liability

To the maximum extent permitted by applicable law, Volusia Websites’ liability is limited according to the applicable written agreement and the amount paid for the relevant service.
